The Cost of an OSHA Trench Shoring Violation

A single citation for not using a trench box can exceed $100,000. In fact an Ohio contractor was cited for a May 10, 2016 willful violation of 29 CFR 1926.652(a)(1) totaling $124,709.00.  Just over one month later, the same contractor was later cited on June 15, 2016 in accourdance with 29 CFR 1926.21 (b)(2) for failing to ensure employees working in the trenches were thouruoghly trained in the hazards associated with trenching and excavating an the regulations applicable to such operations. This violation came with a proposed penalty of $12,471.00. In total the proposed penalties for this contractor came to be $274,359.

The True Cost

OSHA penalties can be very costly and burdensome on a company.  However, they are do not even begin to compare to the burdon of bearing the loss of a life or sustaining a life altering injury. As in the case of this contractor, the May 10th inspection and citation should have been a sufficent warning for this contractor. Unfortunatly, the June investigation and citation began when a young man of 33 years lost his life working in a 12-foot trench that collapsed.  Nothing can replace the loss of a life.  Please do all you can to prevent the same tradegy from happining to someone whom you are responsible to protect.

The use of a trench box costing less than $10,000 could have prevented this loss of life.

Psalm 104 demonstrates the care God has for His creation, and creations dependency on God. Verses 10-12 attributes the flow of steams to God, for the purpose of giving drink to annimals. Verse 14 the growth of grass for the livestock, along with the growth of the farmers plants is caused by God. Verse 16-18 recognizes the trees are created for the birds, and the mountains for the wild goats, and the rocks for the rock badger.

Everything is Created for a Purpose

However, we often fail to recognize these simple truths, let alone put our faith in them. Verse 21 has been my favorite for years “The young lions roar for thier prey, seeking thier food from God”. That is both awsome and humbling to think the Lion, the King of the jungle seeks his food from God. In fact, I view this as saying his roar is a prayer to God for food. We are instructed in the Lord’s prayer to seek God for our daily bread, yet most of us fail to do so. Perhaps we think we are mightier than the Lion. Or perhaps we are just often forget or are blind to these simple truths found in Psalm 104.

“These all look to you, to give them their foood in due season. When you give it to them, they gather it up; when you hide your face, they are dismayed; when you take away their breath, they die and return to dust. When you send forth your Spirit, they are created and you renew the face of the ground.” Psalm 104:27-30

A. An excavation is any man-made cut, cavity, trench, or depression in an earth surface that is formed by earth removal. A Trench is a narrow excavation (in relation to its length) made below the surface of the ground. In general, the depth of a trench is greater than its width, and the width (measured at the bottom) is not greater than 15 ft (4.6 m). If a form or other structure installed or constructed in an excavation reduces the distance between the form and the side of the excavation to 15 ft (4.6 m) or less (measured at the bottom of the excavation), the excavation is also considered to be a trench.
